1. Introduction

Welcome to Khojo! These Terms of Service ("Terms") govern your access to and use of the Khojo website, mobile application, and services (collectively, the "Services"), operated by Khojo Travel Technologies ("Khojo," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. Please read these Terms carefully before using our Services.

2. User Accounts

2.1 Account Creation

To use certain features of our Services, you must create an account. When you create an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.2 Account Eligibility

You must be at least 18 years old to create an account and use our Services. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

  • Using any automated means, including bots, scrapers, or similar technologies, to access the Services
  • Posting or transmitting any content that is unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene, or otherwise objectionable
  • Uploading or transmitting viruses, malware, or other types of malicious software
  • Collecting or harvesting any information from the Services, including user accounts

3.2 Content Guidelines

You are solely responsible for the content you post on the Services. You agree that all content you post complies with these Terms and does not violate the rights of any third party. We reserve the right to remove any content that violates these Terms or that we find objectionable for any reason.

4. Booking & Payments

4.1 Booking Services

Khojo allows you to book travel services provided by third-party suppliers, such as hotels, tour operators, and activity providers. When you make a booking, you enter into a contract directly with the supplier, and Khojo acts as an intermediary. You agree to review and comply with the supplier's terms and conditions.

4.2 Payment Processing

We use third-party payment processors to process payments for bookings and other services. By making a payment, you agree to the terms and conditions of these payment processors. You represent and warrant that you have the legal right to use any payment method you provide.

4.3 Fees and Taxes

The prices displayed on our Services may include service fees charged by Khojo and may not include all applicable taxes and charges. You are responsible for paying all fees, taxes, and charges associated with your bookings.

5. Cancellation

5.1 Cancellation Policies

Cancellation policies vary by supplier. The specific cancellation policy applicable to your booking will be displayed before you complete your booking. You agree to review and comply with the cancellation policy for each booking you make.

5.2 Refunds

Refunds are subject to the supplier's cancellation policy. If you are entitled to a refund, the refund will be processed according to the supplier's refund policy and the payment method used for the original transaction.

5.3 Modifications

If you need to modify a booking, the ability to do so and any applicable fees will depend on the supplier's policies. You should contact the supplier or Khojo customer support for assistance with modifications.

6. Community Guidelines

Khojo is a community-based platform, and we expect all users to treat each other with respect and courtesy. Our community guidelines include:

  • Treating all users with respect and dignity
  • Being honest and transparent in your interactions
  • Respecting the privacy and personal boundaries of others
  • Providing accurate and helpful information in reviews and comments
  • Respecting local cultures, customs, and laws when traveling
  • Reporting inappropriate behavior or content to Khojo

Violation of these community guidelines may result in the removal of content, suspension, or termination of your account.

7. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease, and you must cease all use of the Services.

You may terminate your account at any time by contacting us at support@khojo.travel. Termination of your account may not result in the removal of content you have posted on the Services.

8. Limitation of Liability

To the maximum extent permitted by law, Khojo and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content
  • Any transaction or relationship between you and any third-party supplier

In no event shall our total liability to you for all claims exceed the amount paid by you, if any, for accessing or using our Services during the twelve (12) months preceding your claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be brought exclusively in the courts located in Bengaluru, Karnataka, India, and you consent to the personal jurisdiction of such courts.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
